Cyclists' Rights and Responsibilities

Follow the links below to information about riding safely—and legally—in Florida.

Florida Bicycling Street Smarts Written by John Allen with Florida portions produced by the Florida Bicycle Association, this book was made possible through funding from the Florida "Share the Road" license plate program, and from the State Safety Office of the Florida Department of Transportation. Click on the link to find out how to get your free copy.

Florida Vehicle Code Sections of the code pertaining to bicycles. We've summarized; for the official version you'll have to dig through the code here.  Also see (next paragraph, below) an Adobe Acrobat pdf copy of the booklet we created for and are distributing to Florida law enforcement officers.

Florida Bicycle Law Enforcement Guide This booklet was created specifically to help familiarize law enforcement officers with portions of the Florida vehicle code that relate to two-wheeled human-powered vehicles. Included are motor vehicle responsibilities related to sharing the road with bicycles.

Florida Pedestrian Law Enforcement Guide Incorporated into the Law Enforcement Guide in September, 2006, this section is intended to help law enforcement officers with portions of the Florida vehicle code that relate to pedestrian and motorist rights and responsibilities.

Bicycle Crashes—Know and Protect Your Rights This article by Jacksonville attorney and long-time cyclist Christopher Burns provides a step-by-step process to follow if you've been in an accident. Another excellent multipart series on the many facets of crash recovery can be found in the FBA Messenger beginning with the Winter 2003 issue. Written by former FBA board of directors member Duke Breitenbach, the series is a point-by-point account of the many issues he faced over a 4-year period after being hit by a truck. Duke covers the things you should consider, from the time of the event to the final settlement negotiations...or court battle. It's information you need to know before an accident occurs.

Off-road Code of Conduct Some common and not so common sense rules for how you should treat others and the environment when you head into the woods.

Group Riding brochure and video Brochure in pdf format is available on this Website. E-mail laura@floridabicycle.org to request a copy of the DVD. Eight public service announcements plus narrative, and is only $5 for shipping and handling.

How Far Right...Is Right? The Bicyclist's Legal "Grounds for Taking the Lane" An essay by current FBA president Mighk Wilson on statutory basis for moving out from the "as close to the right edge of the roadway as practicable" path designated for bicycles when the roadway is too narrow to safely share with motorized vehicles.

The Bicyclist's Legal Grounds for "Taking the Lane" Another version of the same subject.

Freedom from Fear Mighk Wilson again with a thoughtful, well-written study of perception vs. reality based on extensive research and many miles of experience on the roadways.

Pedaling Culture A compilation of most of Mighk Wilson's writings for the FBA Messenger, available in this downloadable pdf document.
